Presstopia Shop License Agreement

This License Agreement is a legal agreement between you (the "Purchaser", "Customer", or "You", either an individual or a single entity) and Presstopia for the Software Product identified above, which includes computer software, and may include associated media and online or other documentation ("Software Product" or "Software"). By installing, copying, or otherwise using the Software Product, you agree to be bound by the terms of this License Agreement. If you do not agree to the terms of this License Agreement, you may not install, copy or otherwise use the above Software Product.
1. THIS SOFTWARE IS PROVIDED "AS IS" AND ANY EXPRESSED OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL PRESSTOPIA OR ITS CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
2. This License Agreement grants you a non-exclusive, non-transferable license to install, use, and modify the Software Product as authorized below :
a) You may install the Software Product on any number of servers for which you are the Administrator, Developer, or User.
b) SUBSCRIBERS ONLY: If you are a Presstopia Subscriber, you may make modifications to the source code of the Software Product and install the modified version of the Software Product on any number of servers for which you are the Administrator, Developer, or User. The copyright of the original code remains with Presstopia.
c) Under NO circumstances can you (or your customers) resell, rebrand, repackage, or redistribute copies of the Software Product or derivatives thereof in any medium, with or without modifications, in SOURCE or OBJECT form without the explicit written permission of Presstopia.
3. Presstopia reserves the right to refuse permission to use this Software Product to any individual, organization or entity for any reason.
4. Presstopia reserves the right to alter, update or modify the software or this License Agreement at any time and without notice.
5. All instances of the Software Product must display a clearly visible HTML hyperlink that links to the web address "http://presstopia.com", and has the link text "Powered By Presstopia". This link may not be removed unless (a) you are explicitly granted permission to do so by Presstopia, or (b) if you are a Presstopia Subscriber.
6. Copyright messages within the various files that make up the Software Product may not be removed. All title and copyrights in and to the Software Product (including but not limited to all images, photographs, animations, video, audio, music, text, and other information incorporated into the Software Product), the accompanying printed materials, and any copies of the Software Product, are owned by Presstopia. The Software Product is protected by copyright laws and international treaty provisions.
